»The law is back to front - The Tony Martin Case«

This is quite an old one now, but for those who haven't heard it...

Tony Martin is a British farmer who had suffered repeated burglaries of his farm.

When confronted by three burglers in his home, he shot and killed one of them.

Ill complete the tale with quotes from his support goup.
Quote:
When Tony Martin was arrested in 1999, most of those from all over the country and all walks of life who followed the story found it hard to conceive that a man alone in his isolated home, defending himself against an unknown number of intruders in the small hours, could even be charged with murder, let alone convicted

But convicted he was and sentenced to life in prison.
Quote:
The claims of jury intimidation remain 'not proven', although a pointer may be the fact that some potential defence witnesses refused to testify for their own safety, and that the police advised Tony Martin's family not to attend the trial...
...the public gallery of an English court was wholly taken over by the relatives of the three career criminals who raided Bleak House that August night, cheering and punching the air when the verdict was returned, abusing the lone figure about to start his life sentence

Of course he appealed
Quote:
In a judgement which was a slap in the face for law-abiding people, the Lord Chief Justice rejected an acquittal on grounds of self-defence, despite new forensic evidence which supported Tony Martin's testimony, but reduced the conviction to manslaughter on the grounds of diminished responsibility.

No , it get worse
Quote:
One of the three criminals who targeted Tony Martin has been granted legal aid to sue him for 'loss of earnings'. The poor man has since been scraping a living dealing heroin to keep body and soul together - altogether a most worthy recipient of taxpayers money.

So the Burglar (and drug dealer) gets public funding to sue the person he was Burgling.
Shocked
Tony Martin was released last year, but not without a great deal of public protest.

Indeed

The justice system is flawed beyond belief but i also think a lot of this is down to the media, as usual our bloody gutter press have the power to ruin someones life just to sell papers, this poor bloke gets branded a monster while the chavs who broke in get conveniently skirted around then when this story doesnt sell anymore they change to "poor bloke gets hounded by heroin dealing chav scum".

Maybe we are a more humane country because we give rights to the criminals, i mean they are human too...arent they?
why not give them legal aid and ignore the person who they were robbing? why not let them roam free while the person that was defending themselves sits in a cell? why don't we just get rid of judges who have no fucking idea of what life is like because they sit in their comfy homes surrounded by massive fences? give me a shotgun and i'll get them, after all i can claim legal aid and be treated better than the fucker i just tried to murder.

Lower court judges

It has been my long-time conviction that judges whose decisions get quashed by a higher court should lose their earnings of the trial where they made their mis-decision (or at least a considerable amount of the earnings).

This would harm judges who went crazy.

Because, I must say, that practically ALL of silly court decisions are made by lower court judges. This is typical in all countries.
