A 23-year-old middle-school teacher was charged with having sex with a 14-year-old student in a classroom, at her apartment and, once, in a vehicle while the teen's 15-year-old cousin drove.
Detectives said that the cousins provided matching statements incriminating Debra Beasley Lafave and that the 14-year-old described Lafave's apartment and her tattoos and birthmarks. Lafave, who teaches reading in the Tampa suburb of Temple Terrace, was arrested there last week on lewd and lascivious battery charges, accused of having sex with the teen earlier this month at her apartment and in a portable classroom at Greco Middle School. The real problem with this situation is that in America what that teacher did is called rape. It doesn't matter what other countries do because Americans have to obey their own laws. The fact that the cousin watched is just plain weird as far as I'm concerned but not something the teacher should have to take any blame for. The point though is that no matter where or when it happened or what the circumstances were she still broke the law and in a way that not only violates the law of the land but also the agreements she signed when she took the job with the school. Why wouldn't you be able to call it rape? The age of legal consent is 18 in America. Having sex with anyone below that age is called rape. It could have been that the government decided that 17 was the legal age when they made the law but they didn't. The age is the important part when the law is concerned. Besides, think about what would happen if somebody decided what determined rape was the gender of the minor. That's sexism isn't it? posted by Reaganismyhero |

KNN, if you took a closer look at both of those documents that you posted you would see that first of all, the teacher lives/teaches in florida. Second, on the very list you posted via weblink it says that the age of consent in Florida is 16/18. I'm not sure whether the age is 16 or 18 but it certainly isn't 14. Also, why does it matter if he had an erection? If the case came up in a court of law it would be very difficult to prove that the boy had an erection if that was the criterean that they used. The reason the law is gender neutral is so that criminals can't slip through the system on a technicality, like an erection. What if a 14 y/o boy was thumbing through a porno mag when an older man came into the room and took advantage of him. He still would have been raped even though he still had an erection when the deed happened. If the erection was the criterea for rape it makes it could make it much harder to convict that man in court b/c of bogus claims on both sides. If the man wanted to get off the charges all they'd have to do would be to say the boy had an erection so it was ok. Even if the boy did consent in the first place (which is against the law b/c of the age thing), what happens if he decides that he "felt violated" afterwards (which many women use as a good reason to report a man for sexual harrasment/rape) and decided to call the cops on the guy who raped him? Even though it's illegal anyway, he could say that he wasn't turned on and the rapist would go to jail. A good thing right? Not if you consider that he could do the same thing to someone who didn't he didn't have sex with (i.e. someone he had a grudge against) and get the poor guy thrown into jail. These lkinds aws have been thought through in the past by the people that made them. They also had to check for loopholes like the ones you're proposing. I was gonna say "statuatory rape" but it seems One-der-man has beaten me to it. The first part of the conversation was excruciating because of the lack of that term. The fact is that 14 is a young age to have sex, even with people of your own age. Let's leave the fact that it is a boy, not a girl, out of this for now. An adult had sex with a minor and should have known better. The fact that it was his teacher and therefore had not a little authority over the child makes this even more worthy of concern. posted by fatpie42 |
